Date rape is a colloquial or slang phrase for sexual assault. In a date rape case, the victim typically knows the accused party.
Date rape is essentially nonconsensual sexual contact during a voluntary social engagement where the victim did not intend on sexual contact or provided no consent. A victim does not have to physically object to sexual contact to demonstrate lack of consent. If a victim is intoxicated, he or she is incapable of giving consent.
The extreme complexity that these cases present can create significant difficulty for both the prosecution and defense. “Roofies” (Rohypnol) or alcohol may inhibit the victim’s memory. The complexities of toxicology as well as consent may make for very complicated court cases.
